These terms cover purchases made through shop.swellframe.co, operated by Swellframe, Inc.

What you are buying

A Swellframe is an always-on e-ink display that shows surf, wind, tide and forecast information. It is a one-time purchase that includes the forecast service the device needs to work. Optional annual subscriptions add extra features and are described at www.swellframe.co.

Forecast information

Forecast data comes from third-party providers and is provided for information only. We do not guarantee its accuracy, completeness, or timeliness. Do not rely on it alone for safety-critical decisions.

Orders and pricing

All prices are in US dollars. We may correct pricing or description errors and cancel an affected order, refunding you in full, if an order was placed at an incorrect price. Sales tax is applied where we are required to collect it and is shown before you confirm.

Warranty

Every new Swellframe includes a one-year limited hardware warranty. The full terms are at https://www.swellframe.co/warranty.html.

Account and device setup

Setting up a device requires a Swellframe account and a Wi-Fi connection. Use of the account and the forecast service is governed by the full Terms of Service at https://www.swellframe.co/terms.html, which apply alongside these store terms. Where the two conflict on a purchase made in this store, these store terms apply to the purchase itself.

Text messages

If you tick "Text me with news and offers" at checkout, you agree to receive recurring automated marketing text messages from Swellframe, Inc. at the mobile number you provide. These can include a reminder about items left in your cart, product news and offers. Consent is not a condition of purchase.

Message frequency varies, and we send no more than 4 marketing texts a month. Message and data rates may apply.

To stop receiving texts, reply STOP to any message or use the opt out link in the message. You will receive one text confirming that you have been unsubscribed, and no further marketing texts after that. For help, reply HELP or email hello@swellframe.co.

Mobile carriers are not liable for delayed or undelivered messages.

To sign up, you must be 18 or older and be the account holder of the mobile number, or have the account holder's permission.

We do not sell or share your mobile number or your consent to receive texts with third parties for their own marketing. Our privacy policy explains how we handle your information.

Limitation of liability

To the fullest extent permitted by law, our liability arising from a purchase is limited to the amount you paid for the affected order. Nothing here excludes liability that cannot lawfully be excluded.

Governing law

These terms are governed by the laws of the State of New Jersey, United States, without regard to conflict of law principles. Disputes will be resolved in the state or federal courts located in Monmouth County, New Jersey.

Your legal rights

Nothing in these terms limits any rights you have under applicable consumer-protection law.
